- We are Next Resources Limited of 4 Kentstone avenue, Heaton Mersey Stockport, SK4 3RE, with company number 10182793. Bilingual Recruitment is a brand of Next Resources LTD.
- “we”, “us”, “our” and “ours” refers to Next Resources and all brands of Next Resources including Bilingual Recruitment.
- You are a Client or potential Client of ours and are the recipient of these Terms of Business and “you”, “your” and “yours” refers to you. For the purposes of this agreement “you” includes any subsidiary or associated company (as defined by s.736 Companies Act 1985) of yours.
- By accepting or requesting any services or using information from us you are deemed to accept these Terms of Business (the “Terms”), which apply to all dealings between us relating to the business described in the Terms and override any terms proposed by you unless we have such terms in writing and agreed by a director of Next Resources. Upon such acceptance, and in consideration of the mutual benefits set out herein, it is agreed as follows:
Definitions & Meanings
- In these Terms the following words and phrases shall have the following meanings unless the context requires otherwise:
- "Advertisement" means a notice designed to attract Applications from Candidates in relation to a Client’s Requirement.
- "Application" means a Candidate's response to a Client’s Advertisement.
- "Candidate" means a person who responds to an Advertisement.
- "Credits" a credit entitles the Client to place one Requirement with Next Resources, and is valid for twelve months from the time of purchase (at which point it will expire). The Fee for a Credit is as set out on the Site from time to time and may vary; however variations will not affect Credits already purchased (if the charges change, Clients will not be charged extra or offered a refund or partial refund for Credits already purchased but not used).
- "Fees" means the fees and charges payable by the Client as specified or referred to in these Terms.
- "Loss" means any action, claims, costs, damages, demands, expenses (including legal expenses on a solicitor-client basis) fines, liabilities, losses or penalties.
- "Material Misrepresentation" means any deliberate hiding or falsification of a material fact which, if known to us, could have significantly altered the basis of the contract.
- "Requirement" means a request from the Client in any form for Next Resources through Bilingual Recruitment to provide advertising, searching and filtering service. For the avoidance of doubt Bilingual Recruitment is not acting as an employment agency as defined in the Employment Agencies Act 1973. Bilingual Recruitment is purely a venue for employers and Candidates to meet and is not involved in the actual transaction between Clients and Candidates.
- "Resume" means the curriculum vitae or any other document which outlines the details of a Candidate's education, training, skills and employment experience which is provided to Bilingual Recruitment by a Candidate for distribution to Clients with a view to securing a Requirement.
- "Service" means any service that Bilingual Recruitment provides to its Client under the terms of their contract. "User" means any person acting on behalf of the Client and authorised by the Client to use the Client's Account.
We may amend these Terms from time to time and notice of this will appear on the Bilingual Recruitment website and continued use of the Services after the provision of such notice will constitute acceptance of the revised terms.
The service of Bilingual Recruitment:
The following explains the steps involved in the standard recruitment services offered by Bilingual Recruitment. Further details, and information about other Services are then provided in the rest of the Terms:
- 1. Client agrees Terms & Conditions
- 2. Client defines its Requirement and email job description to Bilingual Recruitment
- 3. Client purchases Credits
- 4. We upload the Advertisement to selected job boards
- 5. We screen and filter Applications received and make suitable ones available to the Client
- 6. Resume Search: Bilingual Recruitment will undertake a search of its Resume database and/or those of third parties and will verify that Resumes provided are up to date and that the individual is available for work.
- 7. The client interviews candidates and makes offers to suitable ones.
Credits and Requirements
- 1. In order to recruit, it must begin by purchasing the requisite number of Credits.
- 2. Once the Client has purchased the Credits, it should define its Requirement, create its Advertisement and email to Bilingual recruitment.
- 3. For the avoidance of doubt, the Client shall not be entitled to a refund in respect of Credits purchased but not used.
- 4. Clients should note that if they receive multiple Applications in response to a single Advertisement, they are free to recruit all Candidates, and that no additional monies are payable even if only one Credit was used to place the original Requirement.
- 5. Clients should note that where inadequate or non-specific information is provided in a Requirement it will reduce Bilingual recruitment's ability to target the Advertisement effectively and may well reduce the level or quality of response.
- 6. The Client must ensure that the Requirement and Advertisement are accurate and gives a true picture of the vacancy.
Advertisement of the Requirement
- 1. Once the Client has emailed its Advertisement to Bilingual Recruitment, Bilingual Recruitment will use its experience of the recruitment market to select appropriate online job boards and job categories (at its discretion). Bilingual Recruitment does not guarantee a deadline for this, but will post the Advertisement reasonably promptly.
- 2. Bilingual Recruitment regularly changes the job boards that it posts Advertisements to. As such certain job boards may not be available after purchasing Credits. Furthermore new job boards that are added after the Advertisement for a Requirement has been placed may incur an additional fee.
- 3. Because not all job boards use the same parameters, Bilingual recruitment will use its discretion and experience to tailor Advertisements in order to meet the parameters accepted by a specific job board and will do so on the basis of its view of what would provide the closest fit with the Requirement.
- 4. The Advertisement will then be available for the period allowed by each job board; this is usually 28 days but can vary from 7 days to 30 days
- 5. The Client acknowledges that Advertisements will usually carry only the branding of Next Resources but may carry the branding of third parties who work with us .
- 6. Once an Advertisement is placed on a job board it cannot be changed; if the Client wishes to amend the Advertisement it must use a further Credit to place a new Requirement. We are not responsible for any aspect of the availability, accessibility or conduct of a job board.
- 7. The Client may withdraw its Requirement for any reason at any time and we will comply with this request; however the Client will not be entitled to a refund.
Applications
- 1. Bilingual Recruitment will email Applications to the Client at intervals to be agreed with the Client;
- 2. We do not guarantee that the service we provide will result in a suitable Candidate being found; Credits will not be refunded if suitable Candidates are not found. The Client is responsible for the selection of the Candidates, for taking up references where relevant, and for ensuring that the Candidate holds valid qualifications and is entitled to work in the relevant locations.
Fees & Payment
- 1. The Fees should be taken as those stated on our website or as otherwise agreed by a representative of Bilingual Recruitment and the Client at the time of receiving a Requirement or (in relation to Credits) at the time of purchasing the Credit.
- 2. Our Fees are subject to change without notice. Changes to Fees will be set out on the Bilingual Recruitment website or via any other means of communication. Such changes will not apply retrospectively to Credits already purchased.
- 3. Payment is due upfront and may be made by credit card, bank transfer or cheque. An invoice may also be issued for upfront payment. Bilingual Recruitment will not start work on your vacancy until payment has been received.
- 4. In the event of any debt claim brought by us for any outstanding payments due, any outstanding amount owed will be subject to the interest rate set out in the Commercial Debts (Late Payment of Interest) Act 1998.
Confidentiality
You acknowledge and agree that:
- 1. you shall keep any information relating to a Candidate confidential and not use it for any purpose other than the purpose you disclose to us at the time the information is requested;
- 2. in relation to a Candidate’s information you will act in accordance with the Data Protection Act;
Liability
Bilingual Recruitment is not liable for any:
- 1. loss of revenue or profit;
- 2. loss of opportunity;
- 3. loss of reputation;
- 4. loss or corruption of data,
- 5. in each case whether direct or indirect.
Termination
We may terminate this agreement at its sole discretion if:
- 1. after providing written notice to the Client of breach of these Terms, such breaches are not rectified within 5 working days by the Client;
- 2. the Client fails to pay Bilingual Recruitment on the due date any sums that may be due;
Governing Law and Jurisdiction
- The laws of England and Wales govern this agreement and all non contractual obligations arising out of it. The parties submit to the exclusive jurisdiction of the English Courts.
